11. INSURANCE – Wallis Events Ltd carry insurance policies for both Public and Employers Liability as well as covering all equipment whilst at base and in transit. Certificates are available on request. It is the Clients responsibility to provide insurance for the equipment hired from the time which Wallis Events Ltd finish construction/delivery until they return to remove the items. Acceptance of the hire contract is taken as acceptance of liability. Replacement price details for equipment can be obtained by contacting Wallis Events Ltd. It is also recommended that Clients obtain event insurance to cover cancellation and abandonment.

12. USE OF EQUIPMENT - The Company asks that the Client makes themselves, or a representative, available at the end of construction/delivery to sign for the items provided and receive relevant instruction on use of the equipment. The Client should ensure that all equipment is used solely for the purpose it was intended. Those persons using the facilities or equipment should use them in a safe and responsible manner and nothing should be done or used in disregard to health and safety of persons, property or equipment or in disregard of any Acts of Parliament or other regulations regarding use. In the event of an equipment malfunction Clients should contact the Company. Clients should not attempt to repair faulty equipment under any circumstances without first contacting Wallis Events. The Client is responsible for ensure Marquees are left in a safe and secure state when not in use.

13. LIABILITY TO THIRD PARTIES - The Company will not be responsible for, and the Client will indemnify the Company against, all claims for injury to persons or loss of damage or property howsoever caused unless it be proved that such injury or damage be caused by faulty material or workmanship or negligence on the part of the Company.

14. ERECTION& DISMANTLING - The Company normally provides labour for erection and dismantling and the cost therefore is included in the hire charge. Clients should not attempt to erect or dismantle any structure belonging to the company unless instructed to do so.

15. DUTY OF CARE – Whilst Wallis Events Ltd, or their contractors, are on site the client has a duty of care towards them. This includes providing a safe working environment, ensuring they are not exposed to unreasonable risks and providing amenities such as toilets and a source of drinking water.

16. WEATHER– Adverse or extreme weather conditions can effect both the equipment used and the planned date of delivery or collection.

(a) Delivery/collection date – Whilst the Company will attempt to honour all previously arranged delivery and collection dates these may need to be altered at short notice should it be deemed that the forecast weather conditions may affect safety. The Company will always give as much notice as possible and will endeavour to reach a mutually convenient alternate date.
(b) Provision of equipment – If the company believes that the forecast weather on the event date would make safe use and operation of the hired items impossible they may decline to install the equipment. This will always be a measure of last resort once all other options have been exhausted. The company will not be held liable for any financial loss incurred to the client or third parties. Please see insurance clause.
(c) Substitution of equipment – It may be necessary to substitute some items of equipment if weather conditions are deemed unsuitable for the original items. Where possible we will give Clients advance notice and substitute appropriate items of a similar value. On occasion it may be necessary to substitute items of a greater value, as the circumstances are beyond our control the Client may be asked to pay a contribution towards the cost of replacement.

17. FORCE MAJEURE While every effort will be made by the Company to carry out any order accepted, the full performance of it is subject to variation or cancellation by the Company consequent on any event outside the direct control of the Company or its employees.

18. SUBSTITUTION OF EQUPMENT - (other than weather related) – On occasion the items originally ordered may become unavailable due to damage or stock levels. Every effort will be made to substitute items on a like for like basis however if this is not possible a suitable item of a similar or greater value will be provided. The client will be made aware of this in advance where possible.

19. CANCELLATION OR PREMATURE TERMINATION OF CONTRACT - In the event of the Client desiring to cancel the Contract after a firm order has been placed the following applies:

(a) In excess of 28 days prior to delivery date - there will be a charge of 25 per cent of the total agreed hire charge made.

(b) 7-28 days prior to the delivery date - There will be a charge of 50 per cent of the total agreed hire charge

(c) Less than 7 days prior to delivery date -The full hire charge will be made.

It is recommended that Clients obtain cancellation and abandonment insurance for their event.

20. HIRED IN EQUIPMENT – Equipment hired by Wallis Events Ltd from a third party company such as generators, toilets, refrigerated trailers, furniture and other equipment and other equipment are hired on behalf of the Client. Any Payment should be made to Wallis Events Ltd unless otherwise arranged at booking.

21. DATA PROTECTION ACT 1998 - The Company works in compliance with the Data Protection Act 1998 and stores client information as per the act. Whilst the Company may be required to share information with relevant government agencies and third party contractors where appropriate (such as for delivery purposes) Client details will never be sold for marketing purposes.
